International human rights standards provide for the principles of equality before the law, the presumption of innocence and for the right to a fair trial by a competent, independent and impartial tribunal established by law, and guarantee competent, independent and impartial tribunal established by law. The importance of these standards in the protection of human rights is underscored by the fact that they are indispensable for the protection of the judicial guarantees.
The organisation and administration of justice in every country should accordingly be inspired by the mentioned principles and standards, and efforts should be undertaken to translate them fully into reality. Only an independent judiciary is able to render justice impartially on the basis of law, thereby also protecting the human rights and fundamental freedoms of the individual.
For these essential tasks to be fulfilled efficiently, the public must have confidence in the ability of the judiciary to carry out its functions in an independent and impartial manner. In protecting individuals, judges have a responsibility to apply domestic and international human rights law. No matter which legal system is in place, judicial reforms should be in accordance with international human rights and rule of law standards.
